Xpressly operates on a decentralized, open architecture. We do not implement traditional login systems, passwords, or centralized user databases. Consequently, the Company does not collect, store, or sell personal identifiers such as names, email addresses, or phone numbers.

1.2 Biometric & Media Data

To enable the Extended Reality (XR) features of the app, local camera access is required. All facial landmark tracking is performed on-device. No biometric data is transmitted to or stored by our servers. Audio and video streams are established via encrypted Peer-to-Peer (P2P) protocols.

1.3 Local Storage

Operational data (e.g., your display name and contact list) is stored exclusively in your browser’s local storage. You maintain full control over this data; clearing your browser cache will remove all locally stored information.

2. Terms of Use

By accessing or using the Xpressly application, you agree to comply with these Terms of Use and all applicable laws and regulations.

2.1 Use at Your Own Risk

Xpressly provides an unmoderated, open-access communication environment. By using this service, you acknowledge that you may interact with unverified third parties. The Company assumes no responsibility for the conduct of users or the content shared during P2P sessions.

2.2 Intellectual Property (IP)

All software code, 3D models (including avatars and environments), brand assets, and user interface designs are the exclusive property of iTSikhwal Company. unless otherwise stated. Any unauthorized reproduction, modification, or distribution of these assets is strictly prohibited and protected by international copyright laws.

2.3 Prohibited Activities

Users are strictly prohibited from utilizing the platform for illegal activities, harassment, or the distribution of malicious software. Any attempt to reverse-engineer or disrupt the Xpressly network architecture will result in permanent blacklisting and potential legal action.

3. Limitation of Liability

In no event shall iTSikhwal Company, its directors, or employees be liable for any indirect, consequential, or special damages arising out of or in connection with your use of Xpressly. This platform is provided "as is" without warranties of any kind.

4. Third-Party Content & 3D Models

4.1 Non-Ownership Disclaimer

Xpressly utilizes various 3D models and graphical assets to enhance the user experience. iTSikhwal Company. does not claim ownership of the 3D models used within the application. These assets are used under relevant licenses or are included for demonstration of the app's functional capabilities.

4.2 Immediate Takedown Policy

We respect the intellectual property of creators. If you are the legal owner of any 3D model, image, or asset used in Xpressly and wish for its removal, we will take down the content with immediate effect upon verification.

4.3 Mandatory Dispute Resolution

Before initiating any formal legal action or automated DMCA request, all parties are strictly required to contact us directly. This enables a swift, good-faith resolution and the immediate removal of disputed content without the need for litigation.

5. Intellectual Property & Copyright

5.1 Proprietary Ownership

All content included in this application—such as text, graphics, logos, button icons, 3D character models (other than raccoon_head model), code structures, and software—is the property of iTSikhwal Company. and is protected by international copyright, trademark, and patent laws.

5.2 Restriction on Replication

The unique functionality, workflows, and "open architecture" system design of Xpressly are considered proprietary trade secrets. You are strictly prohibited from:

• Replicating, cloning, or imitating the application's functionality.
• Using the "Xpressly" name or logo for any unauthorized commercial or personal project.
• Decompiling or reverse-engineering the source code to extract functional logic.

Any unauthorized use or replication of these assets will result in immediate legal action, including but not limited to Digital Millennium Copyright Act (DMCA) takedown notices and litigation for intellectual property theft.
